 POST-CONVICTION COURT ORDERS NEW TRIAL

On March 1, 2017, the post-conviction court granted relief to Jonathan Rowley. The court agreed with Mr. Rowley's counsel, Dennis Balske, that Mr. Rowley was prejudiced by his trial counsel's sub-par performance for failing to object to improper testimony vouching for the complainant's truthfulness and to the prosecutor's opening statement and closing argument commenting on this testimony. The court also found that Mr. Rowley's lawyer failed to prohibit hearsay testimony that was inadmissible because the state failed to give the defense the notice required by Oregon law.
