Camp Instead of Prison
Judge Simon found that Mr. Haft's trial counsel had failed to investigate adverse information in the presentence report based on the assumption that Mr. Haft was ineligible for a camp designation by the Bureau of Prisons. He found a reasonable probability that he would have sustained an objection to a serious error in the presentence report and would have made a more specific and detailed recommendation to the BOP. He ordered a new presentence report and a new sentencing. The erroneous report was corrected, and Judge Simon issued a new sentencing judgment, on April 16, 2014, in which he made a more specific and detailed recommendation to the BOP that Mr. Haft should be housed at a camp rather than a prison (his original designation). In response, the BOP designated Mr. Haft to a camp facility rather than the prison to which he had originally been assigned.
